1. Definitions:

The General Conditions include the terms specified below:

1.1 System Operator:

Shall mean the first party who owns the electronic payment platform Payzah.com and Payzah Application, or the electronic payment services provider through different payment channels.

1.2 Customer: 

Shall mean the second party whose services are listed in the application and the electronic platform Payzah.com and Payzah Application, or the beneficiary of the electronic payment services.

1.3 Customer's Customers:

Shall mean the users of the electronic platform Payzah Application, or the user of the Website of the Customer who is willing to pay the value of services through different payment channels.

1.4 System: 

The electronic platform Payzah Application or the Website designed owned by the system operator to provide electronic payment services in different channels.

1.5 Operation Manual:

Shall mean the reference for how to use this system that is prepared by the System Operator, which is an electronic version modified in the same way.

1.6 Services: 

Shall mean all the services and contents available through Payzah Company and its customers.

• Verification Code: Shall mean the private secret code or verification code sent by the system.
• Privacy Policy: Shall mean the policy of Payzah Company that governs the processing of personal data which is also amended from time to time.

2. Payzah Application Policy

Payzah Company deals with your privacy very seriously. Please read the following to learn more about our Privacy Policy (Policy). This policy describes how we receive, collect and use information related to our interface, Website, or applications on Payzah.com ("Site, Application or Interface"). Payzah Application and other products and services are provided via Payzah.

(All of the above is referred to as the “product, service or transaction”). 

By accessing this Application, or using a service, product, interface, or Payzah Application, you accept the policies and practices described in this Policy as this Policy may be amended from time to time. Every time you visit the Website, Application or use the Service, you expressly agree and accept our collection, use and disclosure of information you provided as stated in this Policy.

If you are a user who accesses the Website or service from the European Union, Asia or any other region subject to laws or regulations governing the protection, use and disclosure of personal data that are different from the laws of the State of Kuwait, please know that through your continued use of the Website and the service, you shall be subject to Kuwait's law and to this privacy policy as well as the Final User License Agreement.

2.1 Collection and Use of Information for Payzah Application 

When you install the Payzah Application, you will be able to register on the system, and hereby you agree to the following special conditions in each of the following terms applicable in the state of Kuwait, namely:

1. Electronic Account and/ or Digital Account.
2. Trade policies via smart phones.
3. Electronic payment gateways rules.
4. Application Customers Policies.
5. Inclusion of customers.
6. Services and billers.
7. Purchasing services and electronic payment utilities.

We will kindly ask you to provide us with, but not limited to, your telephone number, civil number, passport, driver's license, email, passport details, identity photo or any information about you or the persons you subscribe and purchase subscriptions from the supplier on their behalf, which will be stored on our servers, or any other data whenever required, and will be used as follows: 

• For settlement and resolution of disputes 
• To help promoting the services and products provided to us in any form (electronic or material) or our suppliers involved in the   application.
• To estimate / evaluate the customer's interest in our services.
• To notify you of our products and services updates.
• To identify us and for protection against mistakes, forgery and other criminal activities.
• To activate our Terms and Conditions.

We can use your contact information to send your recommended and personal offers based on your requests and interests.

Payzah application may interact with the SMS application to read the contents of the message and to activate your account in the system. We will not access the contents of any of the messages or other contact lists except after taking your permission.

The user shall agree to the application's eligibility to access the camera property and images on your phone, as well as your contacts and current location.

2.2 Cookies Files and other Automatically Aggregated Data

If you allow your computer/ device or phone to accept cookies files, we may use cookies file on the Website and application. Cookies files are part of the information that a Website transfers to a hard disk of an individual for keeping records. Cookies files work easier on the Website by keeping references and browsing patterns whenever existed on the Website. Personal information will not be aggregated through cookies files and other tracking technology. Yet, if you previously provided personally identifiable information, cookies files may link to that information. Cookies files and tracking information may be shared with third parties. Our servers/ application may automatically collect data about your Internet address when you visit the site. This information, known as the Internet Protocol or IP address, is the number automatically assigned to your computer by your private Internet service provider when you are online. When you request pages from our site/ application, our servers may access your computer’s IP address if your domain name is applied. Your IP address is used to help you identify and collect demographic information about our members and our users as a whole. Our servers may record the indicated pages that link you to us (Ex: other Websites or search engines), as well as the pages you visit on this Website or app, and the ads you've seen and/ or other information about the type of Internet browser, computer, programs and related software as well as the settings you use, and any search terms you have entered on your system that referred you, as well as other Website usage activities and data entered through our servers, we use this information to administer the internal system to help diagnose problems with our servers and to manage our services. This information may also be used to collect demographic information such as the country of origin and the Internet Service Provider.

2.3 Privacy Practices and Third Party sites

You can access our Website and/ or download Payzah application only via App Store (for Apple devices, the Application is in the official App Store and for Android devices their Application store will be the Google Play Store.) In addition, our site may contain other links that allow you to leave the site and access another Website. Some Websites linked to us or listed on our system may have a different policy than our privacy policy in the application or Website. Our policy applies only to personal information that is acquired from the Website or through your use of our services and/ or your relationship with Payzah Application. We encourage you to be careful when you enter any personal information directly over the Internet. We do not assume any responsibility or obligation for such Websites.

2.4 Collection of Analytics

Payzah uses analytics and analytic software (for example but not limited to Google analytics) to help us in submitting reports on user/ visitor behavior information, as well as standard login information for users on the Website and Payzah Application where such information (including but not limited to IP address, data storage, re-subscription services, databases management, web analytics and information processing) in analyzing and evaluating how to use Payzah Application and Website as part of our ongoing efforts to improve the features and services of Payzah Website. Analytics software may access your information for the purposes of carrying out these functions on behalf of Payzah Application and under similar obligations in this Privacy Policy.

2.5 Sharing and Disclosure of Information

We shall not rent, sell or share any user information with any third party, except as specifically described below. We may disclose your personal information if we believe that such action is necessary for the performance of the service or the requirements of the laws.

The company has all the data of the subscribers entered by them immediately upon their subscription with Payzah or when creating an account in the system.

We use third parties to process your payment and/ or billing information you provided on our site or through Payzah Application to facilitate the payment process. We will verbally or in writing ask from any party requesting your personal data to take appropriate regulatory and technical measures to protect your personal data, process data and to comply with prevailing applicable laws, but we will not assume any legal or civil liability for such third party transactions, thus, you must review the terms and conditions of other parties before providing you with payment or billing information.

We may disclose your information if we decide to do so in terms of national security, law enforcement, or other matters of general importance, as disclosure of information is necessary. We may ask you from time to time to provide us with information about your experience that will be used to measure and improve quality. You will not be bound by any obligation at any time to provide us with any of these data. Any and all information submitted voluntarily in the templates prepared for that purpose is used on the system or in any deletion of any information you have accepted to share in) for purposes of reviewing these templates and improving Payzah’s software and products.

We may contact your in order to send you messages about error and service topics. In addition, we reserve the right to use e-mail or notifications property in Payzah or SMS to notify you of any final claims regarding your use of our software, or our Websites or our products including but not limited to claims of infringement of the rights of other parties.

3. General Provisions

3.1 Authorized Access

We take reasonable measures to protect personal information from misuse, loss or unauthorized access. Yet, we do not guarantee that such personal information is not subject to unauthorized access, as we have material, electronic and procedural protection for the protection of personal information.

Personal information is stored on Amazon's Web Services (AWS) cloud servers and is protected by secure networks with limited access to certain authorized employees. Yet, there is no online or 100% secure storage method.

Payzah shall also be entitled to change its Cloud Servers to any other company it deems reliable and privileged to protect information whenever it wishes.

3.2 Commercial Transfers

If we make any commercial transfer, such as merger, acquisition through another company or selling all or part of our assets, then the information collected from users and suppliers will be among the assets transferred as part of this process. The new entity will be required to comply with the same level of protection for personal information as described in our privacy policy.

3.3 Change of Policy

From time to time, we can review this policy. We reserve the right to update or amend this policy or any of our other policies or practices at any time or without notice. If you do not agree with these terms, you may not use the Website, Payzah Application or any other provided services.

3.4 Change or Remove of Information

If you have submitted your email address and would like to update it, you can do so by sending an email to info@payzah.com 

If you no longer wish to receive emails such as offers, updates and news, you can stop the message delivery service by following the instructions listed in each message. In addition, you can remove the email address at any time by sending an email.

3.5 Transaction Fees: 

By using Payzah Application or by providing you with your data and information, you agree to pay the transaction fees during the refund process to other parties, banks or payment channels used within Payzah. You also agree to repay with the transaction manual and the remaining amount of the transaction after deducting all fees.

3.6 Contact Information Approval

By using Payzah Website/ Application and/ or by providing your information, you agree to collect and use the information you’ve disclosed to Payzah in accordance with this Privacy Policy including but not limited to your approcal to share your information in accordance with this Privacy Policy.

3.8 Correspondence and Customer Service

The services provided by Payzah Company can be found at www.payzah.com  and are hosted by Payzah Company and its service providers 

Payzah Company does not operate as an Internet access provider or an electronic money institution. General Terms of Use govern Payzah Application services. By using Payzah system, whether a registration is required or not, you agree to be bound by those General Terms of Use.

4. Cancellation Policy Procedures

We deal with your requests for cancellation by the following steps:

• The cancellation request shall be by e-mail and by phone.
• The service provider must approve the cancellation request if the service is not connected or for other reasons.
• The cancellation request shall be processed during official business hours (working days from Sunday to Thursday only) from 9:00 am to 5:00 pm.
• All cancellation requests for credit cards will be returned to the same credit card of the customer.
• All cancellation orders for debit cards will be by check and/ or bank and/ or cash transfer based on the volume of the amount.

5. Affiliate & Refund Policy & Procedures

We ask you refund the funds in the following cases only:

• Failure to deliver the product or service, for example but not limited internet disconnection or any technical error during processing. 
• The product or service is not as described in the application or location. 
• Recurrence of payment for the same product or service and the user's desire to refund the amount paid minus all expenses incurred by either the system operator or the service provider.
• The request for refund of the funds shall be by e-mail and by phone.
• Refund requests are processed during official business hours (working days from Sunday to Thursday only) from 9:00 am to 5:00 pm..
• All credit card refund requests will be returned to the same credit card of the customer.
• All refund requests for debit cards will be by check and/ or bank and/ or cash transfer based on the volume of the amount.

6. Legal Liability

• We shall not assume any liability for any indirect or consequential damages including loss of profits, loss of business and loss of reputation. We shall not also assume any responsibility for any losses arising from compliance with legal and regulatory requirements.
• Nothing in these terms shall be construed as an exception to legal liability as a result of death or personal injury as a result of negligence, fraud, forgery, fraudulent forgery or any other legal responsibilities that are not subject to implementation or completion of the agreement between the two parties.
• Our commitment under these Terms is limited to providing you with the services provided directly via Payzah, and we will not release any statement about it, or document the quality, integrity or legality of any goods or services provided to Payzah users 
• We will not be responsible for the assessment or payment of any taxes, customs duties or other costs arising from business transactions between you and the other parties or a Payzah customer.

 7. Compensation

• Damage and harm from and against any losses, damages, claims, costs or expenses (including legal fees, fines and penalties) which we incur or suffer as a result of, or arising from the violation of those conditions, legislation or regulations in force and/ or the use of Payzah services (adhered to by the user).
• Correspondence is made by Payzah via e-mail, telephone, conversations, or mobile application notifications. You can contact us at any time by sending messages to email info@payzah.com.
• Customer service is available from 09:00 am to 05:00 pm from Sunday to Thursday. Within this period, we will endeavor to resolve all queries in the soonest possible time.
• Inquiries received after the end of the specified business day will be treated as arriving on the next business day 
• Standard correspondence will be executed via e-mail. For this purpose, you must keep at least one email address and mobile phone number in your Payzah account. You are also requested to check incoming messages on a regular and recurring basis. Email messages may contain links to other messages on our Website or Mobile application.
• We will communicate in Arabic or English. You can set your favorite language on your file. Supported languages in Payzah and/ or the Website have been included.

 8. Governing Law

• Terms of use and all disputes and claims arising out of or relating to them shall also be construed in accordance with the laws of the State of Kuwait.

 9. Ammendments to Those Terms

• We may fully or partially amend or supplement these Terms.
• Our Terms and Conditions will be updated on the system and will become valid and effective, and will be considered as user-approved.
